1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and Spekta (“Spekta”, “we”, “us”, “our”) governing your access to and use of the Spekta platform, including the web application, API, and MCP server (collectively, the “Service”).

By creating an account, clicking “Get Started”, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and “you” refers to both you and the organisation.

Spekta is a SaaS analytics and AI platform designed for professional event organizers. The Service enables you to:

Spekta is a tool for accessing and analysing data you already own and have the right to access. We do not create, modify, or publish ticketing listings on your behalf.

Permitted use

You may use the Service solely for lawful purposes and in accordance with these Terms. You agree to use the Service only to access and analyse data for events that you organize, manage, or have explicit authorisation to access on behalf of an event organiser.

You must not, and must not allow anyone else to:

Violation of these prohibitions may result in immediate suspension or termination of your account without refund, and may expose you to legal liability.

Usage-based add-ons

Additional MCP query packs (100 queries for €10) may be purchased on the Pro plan and are billed immediately. Add-on queries do not roll over to the next billing period.

6. Refund Policy

7-day money-back guarantee on Pro. If you upgrade to a Pro plan and are not satisfied, you may request a full refund within 7 days of the initial charge by emailing contact@welkom.eu. This guarantee applies to the first charge only and may not be used more than once per account.

7. Data & Credentials

Permission to connect

By connecting a ticketing provider account, you grant Spekta permission to authenticate with that provider using the credentials you supply and to retrieve event, ticket, revenue, and attendee data on your behalf. You represent and warrant that you have the legal right to access this data and to authorise this connection.

If your connected providers surface attendee personal data (names, emails), you acknowledge that you are the data controller of that attendee data and that you have a legal basis for processing it. Spekta acts as a data processor on your behalf for such data. Our data processing obligations are described in our Privacy Policy.

8. Intellectual Property

Spekta's platform

The Spekta platform — including its software, design, AI models, MCP server, connectors, trademarks, and all other proprietary technology — is and remains the exclusive property of Spekta. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely as described herein. Nothing in these Terms transfers ownership of any Spekta intellectual property to you.

Your data

You retain all ownership rights in the data you bring to the platform — your event data, ticket sales, attendee records, and any other content you upload or sync. You grant Spekta a limited license to store, process, and display this data solely to provide the Service to you. We do not use your event or attendee data to train AI models, for advertising, or for any purpose other than operating the Service.

Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant Spekta a perpetual, irrevocable, royalty-free license to use that feedback for any purpose, without any obligation to compensate you.

9. Third-Party Integrations

Spekta integrates with third-party ticketing platforms including but not limited to Eventbrite, Weezevent, TicketTailor, DICE, Shotgun, Ticketmaster, AXS, and 20+ others. You acknowledge and agree that:

To the maximum extent permitted by applicable law:

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Spekta and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

By you

You may cancel your account at any time from the Settings page. On cancellation, your subscription ends at the close of the current billing period, after which your account is downgraded to the Starter (Free) tier or closed, depending on your preference. You may request full account deletion by emailing contact@welkom.eu; we will delete your data within 30 days.

By Spekta

Spekta may suspend or terminate your account, with or without notice, if:

On termination, your right to access the Service ceases immediately. Sections that by their nature should survive termination (including Sections 8, 10, 11, and 13) will continue to apply.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be submitted for informal resolution by contacting us at contact@welkom.eu. We will endeavour to resolve disputes informally within 30 days.

If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Paris, France. If you are a consumer resident in the European Union, you retain the right to bring proceedings before the courts of your country of domicile and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we do:
