Spekta Terms of Service

These Terms of Service govern your use of Spekta. Please read them carefully before creating an account. By using Spekta you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and Spekta (“Spekta”, “we”, “us”, “our”) governing your access to and use of the Spekta platform, including the web application, API, and MCP server (collectively, the “Service”).
By creating an account, clicking “Get Started”, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and “you” refers to both you and the organisation.
2. Description of Service
Spekta is a SaaS analytics and AI platform designed for professional event organizers. The Service enables you to:
- Connect your ticketing provider accounts (Eventbrite, Weezevent, TicketTailor, and 20+ others) via API or OAuth2.
- Synchronise event, ticket, revenue, and attendee data from those providers into a unified data store.
- Query and analyse your aggregated data in plain language through an AI-powered chat interface.
- Access your data programmatically via Spekta's MCP (Model Context Protocol) server, compatible with Claude Desktop, ChatGPT Custom Actions, and other AI clients.
- Generate cross-provider reports, conversion analysis, and revenue breakdowns.
Spekta is a tool for accessing and analysing data you already own and have the right to access. We do not create, modify, or publish ticketing listings on your behalf.
3. Account Registration
Eligibility
- You must be at least 18 years old to create an account.
- The Service is intended for professional and business use by event organizers and their authorized team members. Personal or consumer use is outside the intended scope.
- You must provide accurate, complete, and current registration information. Misrepresenting your identity or organization is grounds for immediate termination.
Account security
- You are responsible for maintaining the confidentiality of your account credentials (login link, session token, and any API keys generated within Spekta).
- You are responsible for all activity that occurs under your account, whether or not authorized by you.
- You agree to notify us immediately at contact@welkom.eu if you suspect unauthorized access to your account.
- We are not liable for any loss or damage arising from your failure to maintain account security.
4. Acceptable Use
Permitted use
You may use the Service solely for lawful purposes and in accordance with these Terms. You agree to use the Service only to access and analyse data for events that you organize, manage, or have explicit authorisation to access on behalf of an event organiser.
Prohibited conduct
You must not, and must not allow anyone else to:
- Scrape or harvest data — use automated scripts, bots, or crawlers to extract data from the Spekta platform beyond what the API expressly permits.
- Resell or redistribute data — sell, sublicense, transfer, or otherwise make available to third parties any data accessed through the Service without our prior written consent.
- Abuse the MCP API — send requests at a rate exceeding the documented rate limits (100 requests/minute per API key), or attempt to circumvent rate limiting through key rotation, IP rotation, or any other technical means.
- Misuse connected credentials — use ticketing provider credentials obtained through Spekta for any purpose other than syncing your own event data.
- Reverse engineer the Service — decompile, disassemble, or attempt to derive the source code of any part of the platform.
- Interfere with the Service — introduce malicious code, conduct denial-of-service attacks, or take any action that unreasonably burdens our infrastructure.
- Violate applicable law — use the Service in a manner that infringes intellectual property rights, violates data protection law, or is otherwise unlawful.
- Impersonate others — misrepresent your identity, affiliation, or the source of data you connect to the platform.
Violation of these prohibitions may result in immediate suspension or termination of your account without refund, and may expose you to legal liability.
5. Subscriptions & Payments
Plans
Limited MCP queries, 3 provider connections, 90 days of data history. No credit card required.
Unlimited MCP queries, all provider connections, 2 years of data history, priority support, full API access.
Pro — Annual
€490 / year (~€41/mo)
Same as Pro Monthly with a 2-month discount. Billed once per year.
Billing
- All paid plans are billed in Euros (EUR) via Stripe, our third-party payment processor.
- Payment is due at the start of each billing period (monthly or annual).
- By subscribing you authorise Spekta (via Stripe) to charge your payment method on a recurring basis until you cancel.
- All prices are exclusive of VAT. VAT may be added at checkout depending on your jurisdiction.
Auto-renewal & cancellation
- Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
- You may cancel at any time from your account Settings page. Cancellation takes effect at the end of the current billing period — you retain access until then.
- Spekta does not prorate partial months on cancellation.
Usage-based add-ons
Additional MCP query packs (100 queries for €10) may be purchased on the Pro plan and are billed immediately. Add-on queries do not roll over to the next billing period.
6. Refund Policy
7-day money-back guarantee on Pro. If you upgrade to a Pro plan and are not satisfied, you may request a full refund within 7 days of the initial charge by emailing
contact@welkom.eu. This guarantee applies to the first charge only and may not be used more than once per account.
- Refunds are not available after the 7-day window has elapsed.
- Renewals (monthly or annual) are not eligible for refunds once processed, except where required by applicable consumer protection law.
- Usage-based add-ons (MCP query packs) are non-refundable once purchased.
- Accounts terminated for Terms violations are not eligible for refunds.
- Refunds are processed to the original payment method within 5–10 business days.
7. Data & Credentials
Permission to connect
By connecting a ticketing provider account, you grant Spekta permission to authenticate with that provider using the credentials you supply and to retrieve event, ticket, revenue, and attendee data on your behalf. You represent and warrant that you have the legal right to access this data and to authorise this connection.
Your responsibility for API keys
- You are solely responsible for the API keys and OAuth tokens you provide to Spekta.
- You must ensure that the credentials you provide have appropriate permission scopes — do not provide credentials with broader permissions than necessary for read access.
- Spekta encrypts all credentials at rest (AES-256-CBC). However, if a credential is compromised at its source (e.g. a data breach at a ticketing provider), you are responsible for revoking and rotating that credential and updating it in Spekta.
- You should revoke all Spekta API keys from your ticketing providers when you close your Spekta account.
Attendee data
If your connected providers surface attendee personal data (names, emails), you acknowledge that you are the data controller of that attendee data and that you have a legal basis for processing it. Spekta acts as a data processor on your behalf for such data. Our data processing obligations are described in our Privacy Policy.
8. Intellectual Property
Spekta's platform
The Spekta platform — including its software, design, AI models, MCP server, connectors, trademarks, and all other proprietary technology — is and remains the exclusive property of Spekta. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely as described herein. Nothing in these Terms transfers ownership of any Spekta intellectual property to you.
Your data
You retain all ownership rights in the data you bring to the platform — your event data, ticket sales, attendee records, and any other content you upload or sync. You grant Spekta a limited license to store, process, and display this data solely to provide the Service to you. We do not use your event or attendee data to train AI models, for advertising, or for any purpose other than operating the Service.
Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant Spekta a perpetual, irrevocable, royalty-free license to use that feedback for any purpose, without any obligation to compensate you.
9. Third-Party Integrations
Spekta integrates with third-party ticketing platforms including but not limited to Eventbrite, Weezevent, TicketTailor, DICE, Shotgun, Ticketmaster, AXS, and 20+ others. You acknowledge and agree that:
- Spekta is not affiliated with, endorsed by, or responsible for any third-party ticketing platform.
- Third-party platforms may change their APIs, authentication requirements, data structures, or terms of service at any time, without notice to Spekta or to you. Such changes may temporarily or permanently break a connector.
- Spekta is not liable for data unavailability, sync failures, or data inaccuracies caused by third-party platform changes, downtime, rate limiting, or access revocation.
- Your use of third-party platforms is governed by their respective terms of service and privacy policies. Spekta has no control over and assumes no responsibility for those platforms.
- You are responsible for ensuring that your use of Spekta to access third-party platforms complies with those platforms' terms of service.
10. Limitation of Liability
Important — please read carefully.This section limits Spekta's liability to you. It may affect your rights.
To the maximum extent permitted by applicable law:
- Spekta's total cumulative liability to you for any claims arising from or related to these Terms or the Service — whether in contract, tort (including negligence), or otherwise — shall not exceed the greater of: (a) the total fees paid by you to Spekta in the 12 months preceding the claim, or (b) €100.
- Spekta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, or the cost of substitute services, even if Spekta has been advised of the possibility of such damages.
- Spekta is not liable for damages arising from: third-party provider outages or API changes; inaccuracies in data synced from ticketing providers; actions taken based on AI-generated analytics; or security breaches attributable to your failure to safeguard your credentials.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Spekta and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service in violation of these Terms;
- Your violation of any applicable law or the rights of any third party;
- Your misuse of ticketing provider credentials or data accessed through the Service;
- Any attendee personal data you process through Spekta for which you are the data controller;
- Any content or data you submit, upload, or connect to the Service.
12. Termination
By you
You may cancel your account at any time from the Settings page. On cancellation, your subscription ends at the close of the current billing period, after which your account is downgraded to the Starter (Free) tier or closed, depending on your preference. You may request full account deletion by emailing contact@welkom.eu; we will delete your data within 30 days.
By Spekta
Spekta may suspend or terminate your account, with or without notice, if:
- You materially breach these Terms and fail to remedy the breach within 7 days of written notice (or immediately for serious violations such as API abuse or data resale);
- We are required to do so by applicable law or a regulatory authority;
- Continued provision of the Service to you creates a legal or security risk to Spekta or other users;
- Your payment method is declined and you do not remedy the outstanding balance within 14 days.
On termination, your right to access the Service ceases immediately. Sections that by their nature should survive termination (including Sections 8, 10, 11, and 13) will continue to apply.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be submitted for informal resolution by contacting us at contact@welkom.eu. We will endeavour to resolve disputes informally within 30 days.
If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Paris, France. If you are a consumer resident in the European Union, you retain the right to bring proceedings before the courts of your country of domicile and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we do:
- We will update the "Last updated" date at the top of this page.
- For material changes, we will send a notification email to all registered users at least 30 days before the new Terms take effect.
- If you continue to use the Service after the effective date, you accept the updated Terms.
- If you do not agree with the updated Terms, you may cancel your account before the effective date.
